Important - read carefully the following browser extension end-user license agreement (the “Agreement”) before installing the licensed NewsHub Browser Extension ("Browser Extension"). By installing the Browser Extension, you agree to be bound by the Agreement. If you do not agree to the terms of this Agreement, do not install The Browser Extension or remove it if you have already installed it. Do not install or use the Browser Extension until you have carefully read, understood, and agreed to this Agreement. Furthermore, you hereby waive any rights or requirements under any laws or regulations in any jurisdiction, which require an original (non-electronic) signature or delivery or retention of non-electronic records, to the extent permitted under applicable law. The terms of this Agreement constitute the complete and exclusive statement of the agreement between you, or the company on whose behalf you are installing the Browser Extension ("You"), and the developer of such Browser Extension - NewsHub ("Company”), which supersedes any proposal or prior agreement, oral or written, and any other communication relating to the subject matter of these terms.
The Browser Extension is the intellectual property of the Company and is protected by copyright, trademark laws and international copyright treaties, as well as other intellectual property laws. Intellectual property, includes, but is not limited to, computer or software code, scripts, design elements, graphics, interactive features, artwork, text communication, tracker libraries, and any other content that may be found in the Browser extension. All trademarks, service marks and trade names are owned, registered and/or licensed by the Company.
The Company grants to you a limited, worldwide, non-exclusive, royalty-free, revocable, and non-commercial license to: download the Browser Extension to a computer via a web browser; use the Browser Extension as herein set forth in the following section; copy and store the Browser Extension in your web browser cache memory; and print pages from the Browser Extension for your own personal and non-commercial use. The Company does not grant you any other rights whatsoever in relation to the Browser Extension. All other rights are expressly reserved by the Company.
You may not modify, make derivative works of, copy, reproduce, publish, or reverse engineer the Browser Extension, except in the case of reverse engineering, only to the extent required by applicable law. You may not license, sell, transfer, distribute, rent, lease or otherwise transfer or exploit rights to the Browser Extension. You may not use the Browser Extension in any manner that could damage, disable, overburden or impair the Company, nor may you use the Browser Extension in any manner that could interfere with any other party's use and enjoyment of the extension system. You agree that you will use the Browser Extension for lawful purposes and only in compliance with all applicable laws, including but not limited to copyright and other intellectual property laws. Your right to use the Browser Extension will terminate immediately if you violate any provision of this Agreement. Upon termination, you may no longer use the Browser Extension.
3.1 Unless you have the express written permission from the Company, you may not distribute the Browser Extension or any portion thereof to any third parties.
3.2 You may not disassemble or reverse engineer the Browser Extension for any purpose, other than for reviewing the code for personal review, and at all times are bound by the terms of this EULA.
3.3 The Browser Extension is a free-of-charge software. You may not rent, lease, or lend the Browser Extension and may only use it for you own personal, non-commercial use.
3.4 The Company may provide you with support services, and any supplemental software code provided to you as part of those services shall be considered part of the Browser Extension and subject to the terms and conditions of the Agreement.
3.5 You must comply with all applicable laws regarding the use of the Browser Extension.
3.6 You may only use the Browser Extension for your own personal, non-commercial use.
3.7 You may not resell or otherwise transfer the Browser Extension, under any circumstances.
3.8 You may not make modifications to the Browser Extension, or decompile, disassemble, reverse engineer or modify the software or any portion of it. You may not combine other commercial applications with or otherwise prepare derivative works of the Browser Extension.
3.9 The Browser Extension is licensed as a single product. Its component parts may not be separated in any way without approval, in writing, from the Browser Extension.
3.10 This Agreement does not grant you any rights in connection with any trademarks or service marks of the Browser Extension or sub-vendors, affiliates, advertisers or distributors.
3.11 You may uninstall the Browser Extension at any time.
The title and all copyrights in, and to, the Browser Extension (including, but not limited to, any images, icons, animation, and overall appearance of the Browser Extension), descriptive or instructional materials, and all copies of the Browser Extension are owned, at all times, by the Company. All title and intellectual property rights in, and to, the content that may be accessed through use of the Browser Extension, are the property of the respective content owner and may be protected by applicable copyright or other intellectual property laws and treaties. This EULA grants you no rights to use such content.
The Company uses automatic algorithms for collecting materials (news and articles) that are available in free access from other relevant sources, providing the links to them. The Company bears no legal responsibility for the content of such material as it is solely the responsibility of the source which provides the material. The Company respects the intellectual property rights of others and expects its users to do the same. In accordance with the Digital Millennium Copyright Act ("DMCA"), the text of which may be found on the U.S. Copyright Office website at http://www.copyright.gov/legislation/dmca.pdf, the Company will respond expeditiously to notices of alleged infringement that are reported to our designated agent.
Your right to use the Browser Extension continues until terminated by the Company, which may terminate this Agreement and your license to use the Browser Extension at any time, without cause and without notice. You may terminate this agreement at any time by uninstalling the Browser Extension. This Agreement will automatically terminate if you fail to comply with any of the terms of this EULA. Upon termination, you agree to stop using and to uninstall the Browser Extension.
The Company disclaims any responsibility for harm resulting from your use of the Browser Extension. The Browser Extension is provided "as is," with no warranties whatsoever. The Company expressly disclaims to the fullest extent permitted by law all express, implied, and statutory warranties, including without limitation the warranties of merchantability, fitness for a particular purpose, title, and noninfringement of proprietary rights. The Company disclaims any warranties regarding the security, reliability, timeliness and performance of the Browser Extension. You understand and agree that you download and use the Browser Extension at your own discretion and risk and that you will be solely responsible for any damages to your computer system or loss of data that results from the download or use of the Browser Extension.
In no event shall the Company be liable for any damages (including, without limitation, lost profits, business interruption, or loss of data) rising out of use of or inability to use the Browser Extension. In no event will the Company be liable for indirect, special, incidental, consequential (including lost profit), punitive, exemplary, or other damages based in contract, tort or otherwise. The Company shall have no liability with respect to the content or operation of the Browser Extension.
The Company, its affiliates, advertisers or distributors, shall not be responsible for any delays, errors, failures to perform, interruptions or disruptions in the Browser Extension caused by any strikes, lockouts, riots, acts of war, changes in law or regulations, fire, flood, earthquake, storm, power failure or failures of the Internet.
The Agreement may be amended by the Company from time to time, upon notice to you, which may be sent by email or posted on the Website. Your continued use of the Browser Extension after that time shall constitute your acceptance of the amended Agreement. The Company may automatically update or modify the Browser Extension from time to time at its discretion.
